In 1979, the matters were all resolved and were documented that never again will such crisis be meted upon the people. Among the signatures was an educationist who at that time stood on behalf of the youth od Nsawkaw. Surprisingly, the educationist further became and he is still one of the Sub-Chiefs (Gyaasehene) who has gone against the very resolution he signed in 1979. Very laughable!!!

A politician and a minister of in the current administration of the government was directly involved in sending heavy security presence from the national outfit into Nsawkaw to unlawfully install a Paramount Chief simply because, the person who even is not a royal from the town is his brother-in-law. Such an abuse and use of state powers in this era of rule of law. God save Ghana.

There is a pending court case over the Chieftaincy matter since November 2015 and the politician against all norms and the restraining orders of the Brong Ahafo Regional and Wenchi Municipal Police Command, evoked the pundit “order from above” command and sent heavy security from National level who by-passed all orders to enable the unlawful installation of his brother-in-law.

What I wished the politician had learnt were some of the expositionS given on the processes that play out before traditionally Chiefs are installed and not to use powers which definitely have their lifespan at elections and even appointment by the president.

The ruling in the Wenchi Chieftaincy matter by the Supreme Court of Ghana established that installation of Chief without a queen-mother cannot hold. This is very applicable to the situation in Nsawkaw which has no queen-mother, but with political influence, a Paramount chief is installed even against a pending court process.

Brobbey further explains that the significance of the expression “hailing from the appropriate family and lineage” contained in article 277 of the 1992 constitution is very crucial in this specific case of Nsawkaw. In short, the individual who was unlawfully and uncustomary installed, the inlaw of the politician cannot be traced to any of the true royal families of Nsawkaw that by the customs could even be made a Chief.

If not for a deliberate act on the part of the politician and gross disrespect for the people of Nsawkaw where I hail from, the politician knows that the brother-in-law who he helped with heavy security orders to be illegally installed has one of his paternal aunts as currently the queen-mother of Wenchi. The said queen-mother got the victory in the landmark ruling from the Supreme courts of Ghana on the involvement if queen-mothers in the installation of Chiefs. She petitioned the supreme court on a similar unconstitutional installation of Nana Kwadwo Nketiah VII. She petitioned against the Kingmakers of Wenchi – led by Nana Owusu Ansah Kokroko (Krontihene of Wenchi) and on October 26, 2011, the supreme court upheld her case and judged in her favour. It clearly stated that it did not matter that the kingmakers were in the majority, they cannot bypass the queen-mother of Wenchi to install Nana Kwadwo Nketiah VII as a Chief. This landmark judgment clarified once-and-for-all, without any ambiguity that, as per Akan Custom, it is the sole prerogative of the queen-mother to nominate and elect an appropriate candidate from the right royal family and lineage for proper installation to occur. Though the Wenchi’s case travelled through the Brong Ahafo Regional House of Chiefs, it was conclusively determined at the supreme court of Ghana.

How did the politician miss this and allow a relationship to mar his judgement? “I cannot think far”! Is it a case of ignorance? I doubt. It is rather the ecstasy with which political power could cloud our judgement.

I wish the situation could be remedied before the Nsawkaw town is set on fire with the influence that in my view was unwarranted.

Nsawkaw in the Tain Area has had several precedences of chieftaincy matters.
