Considering the sources of laws in Ghana, one cannot overlook the I. Constitution, II. ACTS of Parliament, III. Orders, rules, regulations made under the power of parliament, IV. Existing laws and V. common laws. Even though these are not listed in the order of preference and importance, there is no doubt of the superiority of ACT 527. Precedence has it that all decisions made contrary to the provisions in ACT 527 are more likely to be overturned.

In the current Parliament of the 4th Republic, the facts of the matter remain that a political party after their primaries for parliamentary candidates for the parliamentary elections for the year 2020  had a reason to complain about a decision of one of their sitting members of parliament to the Speaker of Parliament. The facts have it that, the MP in question after losing the primaries decided to go and contest the 2020 Parliamentary elections as an independent candidate. The outcome of the complaint is reported to be the declaration of the seat of the MP as vacant by the Speaker of Parliament. Is the speaker able to make such decisions and what does that decision amount to? These are things needed to be looked into.

It is clear from Article 94 and 97(1)(a, b, c, d, e, and f) of ACT 527 that the eligibility of the MP is not in question since we are not told of his resignation as MP too. It is the understanding that the matter under consideration may come under Article 97(1)(g and h) and the paragraphs state;

97(1)(g) if he leaves the party of which he was a member at the time of his election to Parliament to join
another party or seeks to remain in Parliament as an independent member; or

97(1)(h) if he was elected a member of Parliament as an independent candidate and joins a political party.

Has the candidate chosen to leave his party and joined another party in Parliament? Has he sought to remain in parliament as an independent member in the current parliament yet to be dissolved?

As heard, the Speaker of Parliament has taken a decision to declare the seat of the MP vacant but coming under Article 99(1), only the High Court can determine the membership status of MP and since Article 99(2) gives room for aggrieved persons to seek redress in the High Court when their status as members of parliament are in question, it is the wish of many especially students of the constitution that the MP allows the constitutional processes to roll to make all to live happily ever after.

If allowed to stand as it is, will the MP enjoy the prescriptions of Article 114(1) and all the Privileges and Immunities till the current parliament is dissolved?
